Possibly under the Federal Tort Claims Act. A government can be sued only where it has said that it can be sued, an idea flowing from the old truism, the sovereign can do no wrong. When we had kings that meant you could not sue the king no matter what he did. Today we have a government in place of the king, but the rule still applies, and only cases where the Federal government has said that the Federal courts have jurisdiction to hear those cases can be successful. If the nature of the malpractice was negligence this ought to be actionable.
