No. It's your child. Your family. Your obligation. Clothes, food, toys, or care, custodial or not, you do not get to "write off" what it costs to support YOUR FAMILY. (And in this case, it's to have someone take care of your obligation so you can do something else). These are what you spend your after tax income on. Oh - the tax you pay...that takes care of them and you too.

What if the father does not visit the child as ordered in Florida?

Courts can write orders that create and define the conditions of visitation, such as frequency, duration, holidays, etc. But, courts cannot force the non-custodial parent to participate in visitation or to be a parent. The custodial parent should keep track of dates and the facts that occurred on dates when the non-custodial parent failed to show up for visitation. That information will be useful if you choose to ask the court to modify the visitation order. NOTE: Child support and visitation are two separate issues. Child Support must be paid even if the non-custodial parent never takes responsibility for parenting.

How do you write a letter stating you do not receive child support?

If the question refers to having a court order enforced the interested party should contact the child support enforcement agency in the state where they reside. If there is no existing order of support the custodial parent or legal guardian should file a lawsuit against the non custodial parent(s) in the court of jurisdiction in the county and state where they reside.

Can a non custodial parent change a child's school if the child lives with him in Georgia?

First, the custody order must be modified if the child is not living with the custodial parent. The non-custodial parent does not have the legal authority to make legal decisions for the child. He cannot consent to medical treatment, dental treatment, surgery, cannot enroll the child in school or represent the child in a lawsuit. If the school is doing its job of protecting children it should require proof of custody when the child is registered. That is one of the ways children who have been kidnapped by the non-custodial parent are found.First, the custody order must be modified if the child is not living with the custodial parent. How do you stop child support if custodial parent doesn't want the money?

File suit to have the support order rescinded. However, child support and parental rights are two entirely different issues and a parent cannot be forced to relinquish his or her rights to their biological child. Voluntarily requesting child support termination does not affect the non custodial parent's custodial or visitation rights. The court will only terminate parental rights in cases of documented neglect and/or abuse, and sometimes not even then. In some instances rather than terminating rights supervised visitation will be ordered.

What do you do if the custodial parent alienates your child?

First, document everything. Write down all of the actions that the custodial parent takes to alienate your child from you. Take this documentation to an attorney and ask them to file an action seeking specific court orders prohibiting the wrongful actions of the custodial parent. If the actions are bad enough, the attorney may suggest that you file a motion to change custody to you. In addition to legal recourse, you can take certain steps to protect your child. Be certain not to blame or punish your child for acting out their anger toward you which was instigated by the other Parent. They don't understand why they have certain feelings. Parental Alienation is akin to brain washing a child. There are many other steps you can take to stop alienation, but we don't have the space here to go into detail.

Do you have to pay child support if custodial parent receives food stamps?

Not to that parent. Any money must go to Welfare, so contact child support enforcement to get the money diverted. If you're paying without a court order, those are not considered child support. see links below Recipients of food stamps (now SNAP) and Medicaid do not assign their child support rights to the State - this happens only for recipients of cash assistance. In any case, do not give money directly to the custodial parent/obligee unless you're willing to write it off as a gift.

Can a 15 yr old decide not to visit no custodial parent on a bi weekely basis in ny?

No. The child may only make that decision when they reach the age of majority in the state where they reside (18, in NY). Otherwise, the custodial parent may be held in contempt of court for failing to abide by a court order. Contempt of court may lead to jail or a modification in the custody order giving the child's custody to the non-custodial parent. A child cannot refuse to visit the other parent until they reach 18 years of age in virtually every state in the United States. However, the child DOES have the right to write a letter to the judge with jurisdiction in the case outlining the reasons why they do not want to visit their parent (and those reasons better be good and truthful) or engage an attorney or guardian ad litem to petition the court on their behalf to do the same. The judge may take the child's wishes into consideration, but ultimately, he or she will rule in favor if the best interests of the child, which almost always includes the child maintaining contact with both parents.

Do minors sign 1040 tax form?

If they are old enough to write and understand what they are doing, they can sign their own return. If not, the parent should sign the parent's name and write underneath it "as parent of minor child."

How do you write a legal memoranda for supension of child support due to relocation?

The relocation of a non custodial parent paying court ordered child support has no relevance on his or her obligation to do so. All U.S. states honor and enforce valid support orders under the state's statutes and federal law.
