Best Answer

Yes. However, please note:

1. If the creditor who repossessed your old vehicle sued you and obtained a judgment against you, you would have to pay the judgment in full before buying another car. Otherwise, the judgment could be attached to you new car, and it too would be repossessed.

2. After a repossession, you may find it hard to get financing for a vehicle. If you need financing, check with your local bank or lenders who specialize in giving loans to borrowers with less than perfect credit.

In Georgia Can a repossession company remove your car from your locked garage if the car was a gift and not in your name?

A repossession agency cannot enter a garage locked or otherwise to recover a vehicle unless the agent has a replevin (court) order to seize the vehicle. Additionally, a vehicle cannot be gifted in the usual sense, to another person unless there is a clear title, meaning the vehicle has been paid for in full and there are no lien holders. If the title is not in the person's name who has the vehicle, they do not own the vehicle.

Sure. The owner can't stop the repossession and is aware of the incident, which makes it easier for everyone. * Not if the person is in the vehicle or the repossession agent would be committing a breach of peace, such as appearing at a neighbor's or public place where the borrower was and requesting the keys or another vehicle be moved, etc.

Do you still have to pay for a car if you do a voluntary repossession in the state of Virginia?

Yes.. anywhere. When a vehicle gets repossessed (voluntarily or involuntarily) and it isn't reclaimed, the vehicle gets auctioned... the person who took the loan on the vehicle is still responsible for the difference between what was received for the vehicle at auction and what is owed on the balance of the vehicle (plus repossession, storage, and auction fees).

Can a non licenced person repossess a car?

This depends on the state in which the repossession happens. Not all states require repossession agents to be licensed. All states do require they be insured. Another way to look at this is, if an employee of the lender comes and repossesses the vehicle, they do not require a repo license in any state.

Do you go to jail for driving repossessed car out of state?

The question is a little confusing. If a vehicle has been repossessed then it would no longer be in the possession of the person(s) who made the purchase agreement or to whom the vehicle was registered. If what is meant is can a vehicle subject to repossession be taken out of the state to avoid such action, then the answer would be yes. But it is unlikely that would happen unless the lien holder decided to file it as a stolen vehicle. Which in some states would be perfectly legal and that would mean the person moving the vehicle to another state would encounter some serious legal problems.
