Yes it can be. This is called a "false positive" That being said... False positives are rare but they can happen. Most health providers will do follow up testing to confirm the diagnosis. Rapid HIV tests that yield a positive reading are called "preliminary positives". Your positive result can and should be confirmed with further testing.

The most common test looks for the anti-bodies produced in response to the infection. Since these anti-bodies do not appear right away, you can test negative in the very early stages of infection. You can also test negative in the advanced stages of infection, when the immune system is so compromised that the anti-bodies' numbers are too low to register on the test. It takes about 3 weeks for the test to be considered reliable in most cases. However, allowing for slower immune responses, the accepted rule is that a negative test administered six months after exposure is conclusive.

Can hiv be transmitted even after a negative result of a likely infected person?

Yes. If the person had a "false negative" on their HIV test (getting a negative result even when the person actually does have HIV), then HIV can be transmitted. Sadly, false negatives are common, especially early in the infection. When in doubt, use condoms so that you are not infected with any STDs.
