Let's say the teacher gets a student comes to him/her about getting bullied by another student sending them text messages and names the student doing this. This would be a reasonable cause to look into the phone. Another would be a student is threatening to harm others in the school. Most schools have rules concerning the use of cell phones on campus. If a student is asked several times to put away a phone and doesn't do it that is defiant behavior. The phone can be taken away.

In other words, if they just have a "hunch" that your phone is turned on, or a phone is in a pocket, they cannot search through your personal body unless they have seen you playing on your phone.
Its not against the law...especially if the school asks you to leave your cell phones at home or in your locker or w.e but they shouldn't be able to search you for it unless they have probable cause so a teacher just says hey ima search you for your cell phone you politely decline and say i don't have one :)
Yes, if there is a reason for the search. Let's say that you are suspected of stealing something, so if the teacher searches your book bag it is legal. Your locker can also be searched, but a physical search should only be done by the police/parent/school officals. Civil rights of students are limited and if there is "reasonable cause" for the search it is legal as well as taking the phone since in most schools the phones are not allowed in the classroom.

That will vary. The bigger question is, why would a kid have a cell phone at school? Not being picky, but it makes a difference. If it's against the rules, then the teacher could probably at least take it. If not, then I don't think he should have.
