However, the judgment code of EMT's states "they aren't dead until they are warm and dead". If a patient is cold, and they do not have a DNR on file, begin CPR and warm them up. Then you can pronounce and call the medical examiner.

∙ 9y agoIn certain jurisdictions, yes. Pronouncing someone to be dead is a clinical judgement. Some patients are simply beyond any help and a paramedic can make the call to not attempt any type of critical integration such as CPR and cardiac defibrillation. Some patients it is also not possible or would not make sense to perform CPR on such as those who have severe traumatic injuries or those who are just beyond help. Protocols say when a paramedic can stop CPR and life saving procedures and these protocols vary from department to department. Typically, a paramedic will call the medical director and ask for advice after a certain amount of time that CPR has been taking place. At that point the MD will give certain directives which could include stopping CPR and all life saving interventions. In some jurisdictions paramedics can simply not perform any life saving interventions or stop when they deem necessary because their protocols allows it.
