A non-static (DHCP) IP can be traced to a cable or DSL modem if adequate logging is kept by the ISP and there is a legal reason for them to be forced to release that information. However there could be a large number of devices behind that IP if there is a wireless router or switch connected to the modem. If there is a wireless router connected and it is not secure then any schmuck in the neighborhood that can get the signal could connect to the wireless network and access the internet using the IP of the modem. It they chose to do some illegal activity then the owner of the IP to the modem would be the last traceable point in the investigation and although in this situation innocent would have some tough questions to answer.
