Both of you should work together for the best interests of the child. * Legally, yes. A parent who retains sole custodial rights does not need the permission of the other in matters concerning the minor child. Please be advised that this would not pertain to court order visitation rights of the non custodial parent.

If they have joint custody, the Separation or Divorce Agreement typically states that they need to jointly agree to issues/direction regarding the child's health, education, etc. If the custodial/residential parent has sole decision making ability, that's a different story.
