That will depend on your employment agreement. In most companies testing positive is automatic dismissal, they don't need a second occurance.

this is entirely out of line. first off, if they were passing marijuana around, why would they do a drug test? they were just trying to get people fired. if i were you, I'd march right up to the owner/boss of the business and tell him/her it isn't fair. i know, this isn't the best answer, but i am pretty young.
No, unless the company has a policy claiming drug tests are random, and you can provide some sort of evidence that you were discriminated against and it wasn't a 'random' drug-test. Sorry!!
