yes it can i got a virus just yesterday and it deleted all my miis and corrupted my personal mii. This happened on Mario Kart 7 on-line and it took 5 min to load the next race. I called Nintendo and they told me that has never happened before.

Any viruses for the 3DS would have to be specified for the 3DS. If you're talking about viruses for a computer, and you were planning on putting something off the internet into the 3DS, then no, you would not get a virus. But if someone made a virus for the 3DS only, then yes, you could get a virus.
The DSi can't execute code from the SD card. Even if a virus had been designed to attack a DSi, it could not 'do' anything even if it got onto the SD card.
