No, you can only use it if you have a monster. Yes you keep their monster for the entire duel unless it is destroyed, then it is sent back to THEIR graveyard NOT yours. If it is returned to the hand it will do to the owners hand
if you dont have a monster on the field and you opponent does you cant use creature swap due to the effect. but if you and your opponent does you the creatures that you got from your opponent stays on your field if you dont have a monster try puting a trap monster in your deck it works with the effect
