As a seller of real estate governed by an association -- if that describes your gated community -- you are obligated to inform potential buyers as to the covenants, conditions, restrictions, rules -- the governing documents -- that all owners agree to as a condition of purchase.
You cannot add conditions that are not contained in your governing documents.
If you know, however, that there are violations of the Uniform Building Code, you are obligated to disclose those to any potential buyer.
