It all depends on the facts of the case. If you managed to get out of the store and ditched the proceeds of crime before you were caught, just because you didn't physically have it in your possession, doesn't matter. The theft occurred the minute you passed the last available "pay point" (cash register or check out) as you left the store with the item(s).
all it is is "theft" and after they document theft they specify amount ..... my sister just got arrested for shoplifting and the papers only said "theft between $50-$500" mentioned nothing about shoplifiting
Your parents will hate you, you ll never be able to buy any thing EVER again ,and shoplifting is stupid.
Loss prevention, this is the specific post designated to preventing shoplifting, employee theft, or any other form of shrinkage
For the most accurate legal advice pertinent to your particular situation and jurisdiction, you should consult a qualified lawyer in your area, which I am not. If you actually were shoplifting and/or have pled guilty or been found guilty of shoplifting, you may only have a case for the assault, which an attorney would be better able to determine for you with more information. I assume by assault here, though, you actually mean what is called battery under tort law, e.g. any intentional, offensive touching. Assault is the threat of battery. As for the accusation, if you were not found to be actually shoplifting and so the accusation was false, you may be able to sue the company for slander. If you were detained by the company, you may also be able to sue for false imprisonment.
You can be arrested and detained without a warrant. A criminal attorney can give you some help, and if you have been arrested, you should consult one immediately.
Yes, of course. You can be arrested for theft of any amount.
Any non-employee of the business. Employees who steal from their employers are chargeable under other statutes.
Shoplifting is simply the illegal act or attempt of stealing from a business, particularly a business in the retail industry, such as a grocery store, clothing store, or any other type of merchandise store. An example would be entering a store with an empty bag, then secretly placing merchandise into that bag, and then proceeding to leave the store with no intention of paying for the items within that bag. Shoplifting is illegal within every state of the United States and for that fact in most, if not all of the World. Some Shoplifters can be classified as Kleptomaniacs, which is a psychological term for someone who is compelled to steal, usually objects of little or no value. kleptomaniacs do not necessarily contemplate the value of the items they steal and are usually compelled to steal without any motive of any kind.
If you are in the country unlawfully, you can be detained and deported at any time.
