Citizens cannot "charge" anyone with anything. Only law enforcement and prosecutors have the power to "charge" someone. However, you can FILE A COMPLAINT against the assaulter. After the lapse of 5 weeks it may prove difficult and you had better have credible witnesses and evidence to back up your story. HOWEVER - if you are referring to a DOMESTIC ASSAULT - you can go to court and file for a restraining order agaisnt that person
