I take it you mean for creating a new character for commercial purpose. There is no copyrighted eye drawing styles as far as I know. Copyright usually extend only as far as to the finished manga page or anime.
Any cartoon is technically anime, but if it doesn't have that special Japanese eye style it's called Americanized anime.
