You must file in your state of domicile. So even if you are new to a state, you can file a bk there. However, depending on the length of time you have been there, you might not be able to use the current state exemptions and be forced to use the exemptions of your previous state.
can I start a new business if I'm going to file chapter 7 on my personal debt?
You really need to speak with a lawyer about this. It's all dependent on the bankruptcy laws in your state, what chapter you're filing for, etc. If the vehicle has an order for repossession on it prior to when you filed for bankruptcy, you may not be able to prevent it.
