Yes. If you are in a vehicle with the keys in the ignition, you are considered to be driving that vehicle regardless if it is public or private road. You can be arrested in your own driveway even if you do not even have the vehicle started.

That DUI issue depends on the state in which you reside. In some states if a case is dismissed then so will be any reflection on your driving record. In other states, the DUI will stay no matter. Also, it does not matter if you were on public or private property when you got your DUI, you are not supposed to drive under the influence anytime or anywhere.

The State of Michigan does nor require a Private Road Agreement. But, it's a good idea. The State does require that if you sell a house on a private road that you disclose if the road is not required to be maintained by the county.

Not in Oregon or Washington. Both states (and many others) classify DUI as a traffic crime that is enforceable on any premise open to the public (a parking lor or private road) as well as on a public roadway. HOWEVER, running a stop sign, which is probably not enforceable on private property, may not create any kind of probable cause for a DUI stop. This is definitely a question for a DUI attorney, but I would not consider just running a stop sign (that you probably don't have to stop for anyway) probable cause for any kind of stop.
