You can be charged if you are in possession of it whether it is around a child or not. Smoking marijuana around a child. Absolutely, positively! It is considered a form of child abuse. If you can be arrested and taken to jail for beating a child, then you can serve prison time for allowing the THC (chemical in Marijuana) to enter into a child's system. The child abuse would most likely be considered a misdemeanor and just the potential long-term affects to a young child's lungs and brain would be a felony. If there were actually long-term affects sustained......more time in prison.
