Depends on where you are and the circumstances of the cap busting.

Discharging a firearm within city limits is against the law in most jurisdictions, unless you are at a gun range or some other area with specific permission from the city, OR you are acting in defense of yourself or another against immediate threat of death or serious injury. Some jurisdictions have the "Castle Defense" also, which basically gives you the right to shoot an intruder in your home even if there is not a threat of death or serious injury.

Discharging a firearm outside of city limits is generally permitted, so long as you are not creating any risk of harm to persons or property.
