my first question to you would be, did it ever hit 3rd gear with the shift kit? and then, who put the shift kit in? is it possible something could have been put back together wrong, or left out?

If you only dropped the pan to put a shift kit into it it will probably take 3-4 qts of ATF to fill it. If the transmission and the torque converter is totally empty, probably 10-11 qts.
