If they had been instructed otherwise by the cops, they knew what they were doing, and they broke the law, then perhaps.

Their first responsibility is to their patients. If there was no police officer placed to watch the suspect, I am not sure it is the hospital's responsibility, but the best idea is to consult an attorney and see if what the hospital did broke any specific laws.
