I do not know if you can sue them. But I also am being harrassed by a collection agency in Florida called OSI/Gulf State.I filed a complait with the FTC (federal trade commission). You can also write the collection agency a letter to cease communication. Which means to stop calling you. You can request only to be contacted by mail. I am new to this also. Unfortunately what you may see as harassment, may not appear the same to a judge. You can send them a cease and desist letter. Or simply not talk to them. Caller ID is a useful tool against collection reps. So is voice mail.You can report them to the State's Attorney General, and other agencies. Be advised that this will not stop the calls. If you live in a state that allows taping of phone conversations, it would be a good tactic. Be sure of your legal status first though.Good Luck!
I think you are technically allowed to sue anybody for anything. That does not guarantee it you will win the court case, however.

Unless you have a specific repayment plan that the collection agency agreed to, there is no legal reason that cannot sue the cosigner.
Any collection agency can, in theory, sue you anywhere they can find you. Whether or not they have jurisdiction or a valid claim and whether you have defenses would depend upon the circumstances.

If you are not refusing to pay and you pay the debt, they would have no reason to sue you. If you refuse to pay a valid debt, they may advise their client to sue you depending on what state you are in and what the laws are there. Some states only allow original creditors to sue and not the collection agency.
