No you cannot. They visited my elderley mother and charged her over £1800 for what amounted to be no-more than a very basic Will.

I would advise everyone to steer clear of these cowboys, Lincolnshire Trading Standards are looking into my mothers case and have intimated to me that they have lots of disgruntled people complaining about both Minsters prices and sales tactics.

Be very careful. These people are tied in with "Saga Legal Services" who use the same address and phone no and are NOT the Saga everyone has heard of. They con people into hiring their services by playing on the Saga name and acting as though they are agents for Minster Legal Services. Neither company is registered with Companies House. They are crooks.

Who owns a trust?

A trust isn't something that is owned. A trust is a legal arrangement by which one entity holds legal title to property for another. The grantor of trust, or the entity that created the trust, may think in terms of owning the trust in the case of a revocable trust, however, the title to the trust property is always held by the trustee.

In an irrevocable trust is the trustee authorized to use trust funds for legal fees or defense fees associated with operating that trust?

Typically, the answer is yes. The final answer in each case, however, is dependent upon (a) what the terms of the trust agreement provide, and(b) the applicable state law. In addition, the amount of compensation paid from the trust for legal services sometimes is limited by state law or the terms of the trust to "reasonable compensation", which also is a term of art that varies from jurisdiction to jurisdiction. A reasonable attorney fee charged in New York City may not be reasonable if charged in El Paso. Finally, a trustee who is found to have violated its fiduciary duties may be required in some instances to reimburse the trust for legal fees paid from the trust in defense of such violation.
