Yes as long as the mounting and electrical are the same. However, there will be a slower starting off and it will make your bike non- street legal in some states. If you want to allow your bike to be street legal and not have to worry about cops apprehending or taking your bike away for 1cc of difference for riding on a local neighborhood street or on the highway.

Depends. In South Dakota if motor displacement is 50cc or less AND does NOT require clutching or shifting then no liscense or registration other than a driver's liscense is required. In otherwords if the engine power is transferred to the drive wheel by a centrifical clutch or torque converter (automatic drive) and is 50cc or less no additional liscense is required.
im sure that if the vehicle is under 50cc, you dont need any registration or anything like a permit. so in your case if the said vehicle is 49cc then your fine to ride, just remember to wear a helmet for obvious saftey reasons and also if a law enforcer (cop,life guard) catches you without a helmet you can be fined if you havent already been warned.
