Aside from the Revolutionary War being underway, the problem with the Articles was that they required unanimousratification, i.e. by all thirteen states. This was not accomplished until 1781.Most of the states did not agree with it unless they benefited from it, and they did not care how it affected the other states. Maryland especially wanted Virginia and New York to drop their claims to the Ohio Valley.

The Continental Congress of the United states felt the articles of confederation were not working and ratified a new constitution during the Philadelphia Convention of 1787. The electoral college unanimously elected Washington as 1st president under the constitution.The United States of America was actually formed on March 1, 1781 with the adoption of The Articles of Confederation by Maryland whose delegates delayed its ratification over a western border dispute with Virginia and New York.
