Since the FBI is a part of the Judicial branch and the US is run by checks and balances, it's either th Executive branch (the president) or the Legislative branch (Congress). My best guess would be Congress.

The executive branch can set a person free held by the FBI. The President can use his power of pardon and reprieve granted by the Constitution.
Only the FBI knows all the details, but we will probably know more of it soon, because the FBI has agreed to turn over all of the notes of the investigation to Congress... and depending on their motivations, some of them will surely publicize some of it for political points. The material will be heavily redacted, and will be turned over to Congress still classified, so who knows when we will learn the whole truth.
