I don't know what state you are in, but in some states this constitutes "abandonment"; and it can be defined as abandoning your spouse or abandoning your home and its contents. Some states award the spouse who stayed behind the house and furnishings, etc.
He may be trying to pull a fast one........but if you fear for your safety, absolutely get out.
IF you plan to take the children you may need to clear it with the court.
Your spouses lawyer should send u a letter telling you why they want divorce proceedings
As a U.S. citizen, you would divorce your immigrant husband in exactly the same way that you would divorce a spouse if he was a citizen. I am not sure from your question, but if your husband's green card status is still pending, then divorcing him during the process will affect this application. If your husband was granted a conditional green card, his permanent residence privileges may be revoked if he is divorced within two years from the date this status was granted.
A non-biological "father"; essentially, when a woman remarries after her husband's death/divorce, her new spouse is a step father to her children.
If your spouse has been notified of the pending divorce and fails to respond to the petition within the allotted 20 days, then you can petition the judge for a default judgment of divorce.
You get a divorce and leave the house, before it is to late !
Not without court approval, otherwise the other parent can file an injunction.
after one year if the spouse does not answer an ad inthe local newspaper the divorce is final
No. The appeal is the answer from your spouse for your filing for divorce. A divorce in CA takes 6 months for a basic no fault divorce and with no other problems. Since CA is a community property state you need to settle all the assests in the marriage. Your divorce isn't final until you get the final signed court papers.
Ask your attorney about suing your husband for divorce "in absentia).
Not exactly. Being unfaithful is grounds for divorce, and if they divorce you then you could lose it.
In the Western world there is no such grounds for divorce. A spouse does not need the consent of the other spouse to leave. This is the twenty first century. A husband (you must mean a husband since women never had such control over their husbands) no longer has such authority over his wife.
