You need to be the executor or administrator of her estate, which requires filing with probate otherwise you need another form to get the refund or pay any taxes due the government. Then i was told it had to be sent to the IRS not efile. My daughter's 1040 EZ was sent in 1/24 and has been received and processed and should be sent out by 2/15. I had asked for direct deposit but don't know if that can be done where we had different last names. My daughter died in Florida, where they don't have to file State returns and I live in Maine, no problem as long as the check doesn't get lost in the mail, I will just take the probate paperwork in the bank with the check.

As an executor, I would suggest that you do file a tax return just so that you cannot be questioned by heirs latter for not doing so. It would not be very expensive to file the return, and it could save you lots of problems down the road.

A tax return does need to be filed on behalf of someone deceased for the year in which they died. This is usually done by the spouse, a family member, or an accountant or tax attorney handling the person's estate.
An estate has to be opened for your deceased daughter. That check will be deposited into the estate account. You need to consult an attorney about an estate if you haven't do so already.
