In the United States laws differ from state to state, but there are some common factors. Often, for example, companies are only allowed to test those applicants who are actually offered a position; also, it's commonly required that the prospective employee must be notified of the test and given the option to decline it and withdraw their application. But these are just procedural restrictions. not a denial of the right to do the testing in the first place.
