Normally yes. The main exception is that Playstation Plus users can have the PS3 set to download any updates to games or the system. It still must be on when the download occurs, but the system turns on the PS3 when a download is available. You also have to not be doing certain things while you are trying to download. I found if I watch a DVD or other activities the download will pause until I am finished even though it was set to download in the background.
Maybe you are not old enough to download the game from the Playstation Store or you are trying to download it from somewhere else

A PS3 game download can be paused by clicking "Download in Background." The PS3 can also be shut off, and when it is turned back on the download will resume.
