It can vary, but as a general rule you must be observed either trying to conceal the merchandise -OR- go past the last opportunity to pay for the merchandise while displaying no intention of doing so. This means, once you get past the check out registers you're guilty whether you actually make it out of the store or not.
Really?? If you took merchandise from the store and didn't pay for it you can be charged. It doesn't need to be on video. My advice would be to seek the counsel of a competent attorney, and don't go to the store with an empty handbag and leave with one full of things you didn't pay for.
Not quite. If someone is spotted shoplifting and you believe you have video evidence, you can call the police or perform or attempt to scold them, retrieve your merchandise and ban them from the store.
If they did not detain you, probably not. You are simply barred. Don't go back or they may prosecute you for trespassing.
No you don't because if you leave a shop and you have shoplifted you will know and act very unusualMore detail:You have to have actually left the store, or be on your way out the door without paying for the merchandise before you can be charged with shoplifting.
I believe that the camera speaks for itself. Even though you may have dropped the evidence, your intent was to steal it. I think it would be up to the store to press charges against you.
Yes if the film shows you committing the theft.
