Yes, I do believe since it's on the Marketplace, it would require someone to download it off Xbox Live whether it be through silver or gold membership.

The zombie maps can not be unlocked because they are not part of the game. They are add ons to the game as DLC or Downloadable content. They are not part of your game disc and you must purchase any of the 4 DLCs for Black Ops. You do not need live gold you can purchase the DLC from the Xbox market if you have an online connection.
