That's what the Dairy Queen web site says, but I go to Ontario Mills all the time and I've never seen it and believe me, I have looked. So I don't know what they're talking about. Last I've been there though, half of the food court was under construction. They were putting in a whole bunch of new food places. Maybe they put the Dairy Queen there or are going to in the near future.
Although you may very easily find a lawyer willing to take your money to try, you will not be successful in suing Dairy Queen for lack of a loop, since they are not contractually obligated to provide a loop. Also, it isn't considered false advertising if they never state in any of their advertising that you are guaranteed a loop on the top of your ice cream. However, as a sidenote, Dairy Queen does have a trademark on their "signature curl."
