If you are reffering to the points used in the DSi shop, then they must be purchased. From the DSi shop, click 'Start Shopping', then 'Add Nintendo DSi Points'. You have a choice then of purchasing using a credit card, or redeeming a Nintendo Points Card. If you pay with a credit card they cost £9 for 1000, £18 for 2000, or £27 for 3000. You are also given an introductory 1000 points for free when you first use the DSi shop.
All games are 'copyright', ie, covered by intellectual property laws. To download games on a DSi though, you just need to access the DSi shop from the DSi's menu bar. Here you can spend DSi points (you pay for those at game stores) and buy downloadable games.

The first thing you would want to do is make sure your DSi can connect to the Internet. After that, you go on the DSi menu and go to the DSi shop, Then you click on start shopping at the bottom of the screen. You then click on "Add Nintendo DSi Points" and you click on whatever card you want to pay. If you click on the "Buy Nintendo DSi Points with a Credit Card" After you click that, you click on whatever points you may want but make sure you know how much money you're paying. Click one of the prices, then click on whatever card you would like to use and get a parent or guardian to fill in the state, country, and what other things you need to fill in. Then, you have points so you can go to the DSi shop again and buy downloaded games there.
