I think you technically have to be licensed to sell prepared food and for liability reasons, I would not do it in any case. I could easily own your house if I wanted to and was a bad person if you sold me anything edible.
Not in the restaurant's kitchen, that is a violation of health codes and can void their insurance policy. However if they prepared something for their meal entirely at their table it would be OK.
