Do you receive half of military partners pesion when divorce?

Because of the special circumstances of military life, it may be wise to consult with an attorney who is familiar with both civilian and military law. Federal law (rather than state law)controls the military pension and although you may be entitled to some of your spouse's military pension you may not be entitled to half.

If a husband is retired military and his wife is from another country originally but is now a U.S. citizen and he files for a divorce is she entitled to half of his military pension?

Depends on how long they have been married. The origin plays no factor; the state he files for divorce and time they were married is what matters. I think she has to be married to him for 10 years of his active duty service.
