In general (under current enlistment standards) you will not be able to enlist while you are the subject of a restraining order.

Each service requires its recruits to meet rigorous moral character standards. In addition to the initial screening by the recruiter, an interview covering each applicant's background is conducted at the MEPS. For some individuals, a financial credit check and/or a computerized search for a criminal record is conducted. Some types of criminal activity are clearly disqualifying; other cases require a waiver, wherein the each service examines the circumstances surrounding the violation and makes a determination on qualification.

Here is what the military officially has to say about moral standards of enlistment:

Persons entering the Armed Forces should be of good moral character. The underlying purpose of moral character enlistment standards is to minimize entrance of persons who are likely to become disciplinary cases or security risks or who disrupt good order, morale, and discipline.

Moral standards of acceptability for service are designed to disqualify the following kinds of persons:

Individuals under any form of judicial restraint (bond, probation, imprisonment, or parole).

Those with significant criminal records.

Persons convicted of felonies may request a waiver to permit their enlistment. The waiver procedure is not automatic, and approval is based on each individual case.

One of the considerations in determining whether a waiver will be granted is the individual's ability to adjust successfully to civilian life for a period of time following his or her release from judicial control.

In processing waiver requests, the Military Services shall require information about the "who, what, when, where, and why" of the offense in question; and a number of letters of recommendation attesting to the applicant's character or suitability for enlistment. Such letters must be from responsible community leaders such as school officials, ministers, and law enforcement officials.

Those who have been previously separated from the Military Services under conditions other than honorable or for the good of the Service.

Those who have exhibited antisocial behavior or other traits of character that would render them unfit to associate with military personnel.

When a restraining order is dismissed is visitation still in effect?

If there was a restraining order preventing one parent from seeing their children, and you have not filed for, or been given an extension on that order, it's best to take the matter back to court. You should have your original custody agreement amended to reflect the fact that there was a restraining order keeping the parent from the child.

Is a restraining order in effect only after it is served?

no the restraining order is in effect the second the judge signs it. but a good thing to keep in mind is if you and the defendant are in the room together and the judge signs the order it is in effect but he is allowed to break the order due to the court proceeding you are undergoing. but once you two leave the court room he/she must then follow the order or go to jail.Another View: The order does NOT take effect unless, and until, it is served on the respondant. Until then the respondant can legally claim "no knowledge" of the existence of the order. Avoidance of service is actually a fairly common method of avoiding the restrictions of the order.

Can a restraining order be issued in Colorado even if there was no violence and neither party asked for one nor wanted one?

The short answer is YES!We assume that this order was issued after someone called the police to respond to some type of Domestic Violence incident. In general if the event was serious enough for someone to call the police, the court will often hold that the event was serious enough to require a protection / restraining order. The State of Colorado takes Domestic Violence related cases very seriously and almost always file restraining orders against the accused for the protection and emotional welfare of the victims. The order is issued pursuant to Section 18-1-1001, C.R.S. (Mandatory Protection Order) which states in part:There is hereby created a mandatory restraining order against any person charged with a violation of any of the provisions of this title, which order shall remain in effect from the time that the person is advised of his or her rights at arraignment or the person’s first appearance before the court and informed of such order until final disposition of the action. Such order shall restrain the person charged from harassing, molesting, intimidating, retaliating against, or tampering with any witness to or victim of the acts charged. The restraining order issued pursuant to this section shall be on a standardized form prescribed by the judicial department and a copy shall be provided to the protected parties. If you are subject to a restraining / protection order issued by a Colorado Court, and you have been charged with a Domestic Violence related criminal offense you should consult with an attorney in Colorado. While the order is in effect, you must have NO CONTACT with the protected party.
