You can sue for false arrest at any time. However, you will need to have pretty good proof that the arrest was unlawful though. In the meantime, if the arrest caused you to lose your probation release, it probably will not get you out of jail.
If you can show proof to the prosecutor that you were authorized to possess these drugs with a prescription that pre-dates your arrest, you will probably not even get to court. The prosecutor may just choose to Nolle Prosse your case.

Yes ... and here's why. Prescription drugs are only issued to the person for whom they were prescribed. They need to remain in the original container just for the common sense of identification on what is inside the bottle or package. Federal law prohibits the use of prescribed drugs by someone other than for whom the drug was prescribed, so without knowing to whom the drugs were prescribed (information on the original bottle) the authorities may assume it has been stolen and/or ask for proof that the medicine is indeed yours ... again, the proof is on the original bottle ... without that, what else can they do ... you have no proof positive ... ! The "what else" they can do is retrieve medical records, prescription reports, and speak directly to the physician which prescribed the medicine in the first place, can they not? What if a prescription bottle gets wet and unreadable or damaged? The bottle itself cannot be the only proof positive.
Wow, ten years! You would have to show proof that it was paid or dismissed. If warrant was issued then courts have no proof of this. Need to contact lawyer and show the proof.
