Horvath survived the attack, he was simply knocked unconcious. It's assumed he ran away, because after the fight with Morgana, Balthazar only found Horvath's hat. At the very end of the movie, after the credits, Horvath's hat is shown sitting on a table (near the original sorcerer's apprentice hat that Micky Mouse wore) in what is supposedly Balthazar's Arcana store, and we see a hand with a figurine ring (assumedly a sorcerer's ring) pick up the hat, and the shadow of the person walking away is shown with a cane like the one Horvath used. This was probably meant to set up a sequel to the movie in case one was made.
Just follow the storyline and it will be upgraded, it does that for sorcerers ring level 2 and 3. After that you need to go to the aer krene (weird rock structures spread around the world) to get it upgraded.

No he didn't. I've heard some theories and the best says that his rings are just decorations, and that his power comes from in the ornate gemstone on his belt buckle. Also in the bathroom scene when he tells Dave to hit him with his best shot he tells Dave to take the ring off, and right before Horvath cuts him off he says "it doesn't help me". So his power is only temporarily gone.
