Just go to the E.R. and tell them it's a work comp claim. They will take it from there.

You usually have to apply for workmans comp. just like unemployment . I would go online and fillout and application as soon as possible to get the process started .

First off I do not understand why no one that has a workers comp claim doesn't not go get a comp lawyer. workers comp pays for the comp lawyer. I would call the insurance company and ask why. then go get comp lawyer.
Can you get paid in 1099 and still receive workers comp?
First. My answers are for U.S. Employees ONLY. If you're a 1099 employee and you work in any setting, You are covered by Workman's Comp. If you work for a company and they pay you 1099, but you work for them, same place every day, etc, they MUST carry Workmans Comp insurance to cover you. Now there are a couple of exceptions. For instance you are, or work for ABC cleaning company. If you submit a bill or a bill is submitted on your behalf to garner payment, then it is the bill generators responsability to cover you with Workmans Comp Insurance. If the employer informes you he does and will not carry this type of insurace, and you agree and sign off and are compensated for said lack of coverage, then your "employer" need not carry Workmans Comp Insurance on you. If you want complete details of who and what coverages need to be carried go to Google.com and search Workmans Comp rules & regulations for YOUR STATE or Country, as all states/countries vary a small amount.

Yes this is correct. Workmans comp. drs. only service the injuries. A medical practice that has a family physician is what your looking for. Check with family and friends to see if they can refer you. If your insurance company through your job, if they offer one, also has participating physicians on its plan. If you cant use those sources, go to the local phone book and look for a doctor that can meet your needs and also check them out through the BBB and through the medical association, I think its 1800doctors.
Do you need a lawyer if you had an accident at work that resulted in a head concussion and days off work?
A lawyer won't do much to help you if the local workmens comp insurance is taking care of the medical. You would have to have the state go after the company for negligence before you would have a case that a lawyer could help collect.
How long does it take to receive workers comp settlement check?
That last answer was inaccurate. In South Carolina, we settled on the 1st of September and it is now the 23rd and still nothing. Once the lawyer receives the check, it will sit in trust for 10 days and then WE will get our cut. Honestly, I say someone is trying to get some interest payments off of our money before we get it. Sad, we are the ones suffering. Not the insurance company or the lawyer. within ten days of the decision.

Your hubby can collect the money still if he is still unable to work but if he does go back to work with no pain what so ever you would have resign from the insurance or that would be fraud

No. If you are in prison, you have no living expenses, because your food and lodging are provided for you.
