Many African countries still have their indigenous laws in place. In those countries people can demand that their indigenous laws are used when they are being judged. This is mostly the case in matters of land tenure, guardianship, customary marriages, or succession.

The legal system of the Republic of South Africa is largely based on Roman-Dutch Law, however it was also influenced by the British Common Law system as a result of the inclusion of the country as a colony in the British Empire.

In addition, modern South African law recognises the role that African customary law played in the regulation of disputes amongst the traditionally indigenous population.
