The government (either state or Federal) places the amount of carbon that can be emitted from the exhaust of an engine. You can measure the exhaust gases and determine the amount of carbon. I assume the Government measures gases from different engines to get an average and have studied what they consider dangerous to the environment. I don't know the details of how they select the specific number.
