Naturally, that will be up to a judge to decide. But judges don't go around handing out restraining orders to people simply because they don't like someone. If that were the case, there would be restraining orders in every school, work place, neighborhood, church, etc. There has to be some sort of evidence of harassment or threat or chance of danger.

If your ex has a restraining order on you, then she can NOT give you permission to violate it. If you are caught near her, then even if she swears she wants you there, you may - and most likely will - be arrested. The only way it will drop is if she goes into court and files a motion to modify, with the modification being that she is dropping it. The judge does not have to grant it, but usually will.

Get a lawyer! You have a right to privacy. You can get a restraining order. And if he is accusing her, I'd be accusing him!
