You can't obtain a legal guardianship for a child who does not reside in your jurisdiction. The court would not have any authority to grant a guardianship over a child who lives in another country.

Does the child have the permission of the court or notarized permission of both parents (assuming both have rights) to move? If so, the child would need to establish legal residency where you reside before you could file a petition of guardianship. Otherwise, it would have to be done in the jurisdiction where the child now legally resides. In addition, you may need to secure permission from the court for the child to relocate if this hasn't been done.

You didn't indicate where you currently live, but the laws vary depending on the state and the custodial arrangement now in place. You should consult an attorney.

Can parents lose custody if both are on prescription narcotics and do not keep the children with them?

Yes, if the parents do not "keep" their child with them that implies they leave the child with someone else. That someone else could petition the court for a legal guardianship and gain legal custody of the child. That would be in the best interest of the child and the person with whom the child lives should have legal custody.Yes, if the parents do not "keep" their child with them that implies they leave the child with someone else. Can you move to another state if a child you have guardianship of lives with friends and the friends have temp custody?

Yes you can but how will you be able to moniter the child from another state. I know guardianship means a person legally in charge of the affairs of a minor or a person of unsound mind. Custodial rights differ. I would check with your local court house before making the move so you cannot be charged with abandonment in any way. Verbal agreements in this case may cause a headache.

If both parents of a minor child are unstable can a family member who lives out of state request for guardianship of the minor child?

Yes, through a motion to the court in the jurisdiction of the child's residence. It will be up to the judge to determine if this would be in the best interest of the child.

Can you get child support if the father is a citizen of another country?

If you have custody of the child(ren), and if the father lives in the US, then yes, you can get child support even if he's not a US citizen. If he was ordered by the courts to pay child support and refuses to pay, you can sue him for non payment. They may even order (or you can request) the child support payments to go through the Child Support Enforcement Agency, who will then forward the payments to you. If he fails to pay, then they will take legal action on your behalf. But if he lives in another country, then it may be extremely difficult, if not impossible, to force him to pay the child support unless he lives in a country which signed the Hague Treaty, which provides enforcement for foreigners to pay child support.

Can you ask for legal guardianship if the child lives in a different state than you?
