The iPod Touch should not delete things when you update it. All content should remain on the iPod (unless you have a jailbroken iPod, in which case it will remove all non-App Store apps and other jailbroken features).

You go onto installous or whatever you have and down the bottom there should be a sign saying updates. You click on the game you want to update and install it. Delete the old version.

A jailbroken ipod is legal, and getting jailbroken aps is legal too. But, getting cracked apps (apps which you usually pay for, but you can download for free) is illegal. Eventhough jailbreaking is legal, if you take a jailbroen ipod to an apple store, they won't like it
