There seems always to be a bit of a power struggle between the Legislative and the Executive branches of government. Congress passes legislation that the President is sometimes inclined to veto. Congress can attempt to override the veto, so there is mechanism in place to allow Congress to force its will in spite of an attempt by the Chief Executive to block it. The primary power that Congress has to limit the President's power is control of the Federal pursestrings. Congress decides where money will be spent, and how much.

It is still a robbery, as the intent to steal something from the control of another was there. If there were no intent to steal, and it was not just merely a failed attempt to steal, then it would be battery.
Republicans gained control of Congress in 1866. Radical Republicans had the support of many Northerners who believed stricter measures should be taken against the former Confederate states. After the vicious violence in New Orleans that had killed dozens of Freedman, they supported the Radical Republicans and the Fourteenth Amendment.

Control and violence does go hand in hand. For example: if people lose control, the tendency for violence and mass rioting is always higher. It would then take law enforcement to quell the riots, along with reestablishing peace and control.
