Dolphins do not mark their territory. In fact, they don't have exclusive territories. It isn't possible to have territorial boundaries in the ocean where there are no landmarks to act as boundary lines.

All living things need to be protected. Are we reaally worried about our oceans becoming overpopulated with Dolphins? The world is covered with 2/3 water. There is plenty of room for the dolphins. Lets have open season on the fishermen who kill them in Japan. Thats my choice.
