Labon was drunk when Nephi slayed him. Nephi then dressed in his clothes and tricked his servant into thinking he was laban and took the plates. the servant soon found out but he chose to go with nephi and his family into the wilderness

According to the story found in chapter 4 of 1 Nephi in the Book of Mormon, Nephi entered the city of Jerusalem at night with the intent of getting the plates, but "not knowing beforehand the things which [he] should do." (vs. 6) Previous attempts to buy the plates with his father's inheritance and precious things had been met with violent outbursts from Laban, but Nephi trusted that God could lead him to a solution. As Nephi walked toward Laban's home, he found Laban passed out drunk in the street. Nephi felt "constrained by the Spirit" (vs.10) that he should kill Laban, but protested until he had been told three times that it was the right thing to do. Eventually he realized that killing Laban was the only way to get the plates, and that the plates would be essential to his posterity, so he "took Laban by the hair of the head, and smote of his head with his [Laban's] own sword." (vs. 18)
Nephi then put on Laban's clothes and armor and went to Laban's treasury, where the plates were stored. The servant at the treasury was convinced that Nephi was Laban, as Nephi was able to disguise his voice to sound like Laban. He asked the servant to carry the plates to show his "brethren" outside the city walls, and the servant assumed he meant the brethren of the church and so followed along. Once the servant saw that the brethren were actually Nephi's older brothers, the servant ran, but after realizing that this could be a chance to live as a free man, he agreed to stay with Nephi's family.
