Victims were killed mostly in Indonesia, because that is where it happened. Victims were killed in many ways like, being burnt alive, drowned in the tsunami and by trying to save other victims.
The main cause of death is not the tsunami itself but the buildings that get damaged in the tsunami...ie a bridge or building that falls. The main cause is the water drowning people and building being destroyed. The building may contain people inside it or could crush some people when it falls.
Because the earthquake ocurred underwater was strong enough to produce waves up to 30 meters high which devastated the heavily populated coastal cities of southern Asia. The tsunami was so strong that it managed make victims even in the African coastline located thousands of miles from the quake.

The Red cross helped the tsunami victims in Japan by rescuing them by helicopters and treated the injured with medicine and care. :)

The power of prosecution is reserved for the government. Victims can initiate a civil suit, but only the government can bring criminal charges.
