You aren't asked for a marriage certificate for a passport. You are required to give a birth certificate only. Depending on your state you may also be considered married if over 7 years. I have had 3 passports (keep renewing them) and they are concerned with birth certificate, and the proper passport photo included with application.

Can you charge husband with fraud if he never filed marriage license?

No. The couple applies for a marriage license and then takes it to the official who is authorized by law to perform the ceremony. They sign it along with the witnesses and in the United States:"The person who performs the marriage ceremony has a duty to send a copy of the marriage certificate to the county or state agency that records marriage certificates. Was your marriage even legal if your husband used an incorrectly dated birth certificate when you married and you are now separated?

If the wrongly dated birth certificate wasn't to avoid some other aspect, for instance if he was under the age of 18 and had one that showed he was over 18, it would not invalidate the marriage. He might be charged with lying on an official document.

Is the marriage legal without legal documents?

It depends on the country and in the USA, it depends on the state. If you hold yourself out to be husband and wife in some states, your "common law" marriage can be legally recognized by a court. However, in the majority of states you need legal documentation in the form of a marriage license that is signed and returned by the official who solemnizes the marriage.
